Welcome to CardiacCore CPR, LLC and d/b/a CardiacCore CPR & AED ("Company," "we," "us," or "our")  These Terms of Use (“Terms”) govern your access to and use of our CPR, AED, and First Aid training services, including but not limited to in-person training, online materials, certification programs, and related resources (collectively, the “Services”).

By accessing, using, or participating in our Services, you acknowledge and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use our Services.

1. Accepting of Terms:

By enrolling in or using our Services, you affirm that you:

• Are at least 18 years of age or have parental/guardian consent to participate.
• Students under 18 years old must have their parent/guardian sign a release of liability form in class at registration
• Understand that participation in CPR, AED, and First Aid training involves physical activity and potential health risks.
• Voluntarily assume all risks associated with the training and application of CPR, AED, and First Aid techniques.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of our Services after changes are posted constitutes acceptance of the modified Terms.

2. Description of Services

CardiacCore CPR, LLC provides training and certification services in:

• Cardiopulmonary Resuscitation (CPR)
• Automated External Defibrillator (AED) Use
• First Aid Training 

Our courses align with the guidelines established by recognized organizations, including but not limited to the American Heart Association (AHA). Certification does not guarantee employment or legal authority to practice emergency medical care.

3. No Guarantee or Warranty

We do not warrant that:

1. Training provided will result in successful resuscitation or injury prevention in real-life emergencies.
2. Any individual trained by us will perform CPR, AED, or First Aid correctly in a real-world setting.
3. Certification obtained through our training guarantees compliance with employer, state, or regulatory requirements.
    

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARDIACCORE CPR, LLC, ITS AFFILIATES, INSTRUCTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR:

• ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR PARTICIPATION IN OUR SERVICES.
• PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE RESULTING FROM THE USE OR MISUSE OF TRAINING TECHNIQUES OR EQUIPMENT.
• FAILURE TO PROVIDE MEDICAL OR EMERGENCY CARE BEYOND THE SCOPE OF CPR, AED, OR FIRST AID TRAINING.
   

N NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE TRAINING PROGRAM IN WHICH YOU ENROLLED.

5. Medical Disclaimer

OUR SERVICES ARE FOR TRAINING PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL ADVICE, TREATMENT, OR CERTIFICATION AS A LICENSED HEALTHCARE PROVIDER.

IN A MEDICAL EMERGENCY, ALWAYS CALL 911 OR SEEK IMMEDIATE MEDICAL ATTENTION FROM QUALIFIED PROFESSIONALS.

6. Assumption of Risk & Waiver Liability

By enrolling in our training programs, you voluntarily assume all risks related to:

• Physical exertion during training.
• Potential injury, illness, or other medical conditions that may arise.
• The application of skills learned in real-life scenarios.
   

YOU HEREBY WAIVE, RELEASE, AND HOLD HARMLESS CARDIACCORE CPR, LLC AND ITS AFFILIATES FROM ANY CLAIMS, DEMANDS, DAMAGES, OR LOSSES ARISING FROM OR RELATED TO YOUR PARTICIPATION IN OUR SERVICES.

7. Participant Responsibilities

You agree to:

• Provide accurate and truthful information upon registration.
• Follow all instructions given by instructors during training.
• Ensure you are physically fit and able to participate in CPR, AED, and First Aid training.
   

If you have medical conditions, physical limitations, or other concerns, consult with a physician before participating.

8. Intellectual Property Rights

All training materials, course content, videos, manuals, and instructional guides provided by CardiacCore CPR, LLC are protected by copyright, trademark, and intellectual property laws. "CardiacCore CPR & AED" and "First Aid & Cardiac Life Support Training" and specific single line heart logo is a common law protected trademark and cannot be duplicated or utilized without written consent. In addition, Use of American Heart Association materials in an educational course does not represent course sponsorship by the American Heart Association. Any fees charged for such a course, except for a portion of fees needed for AHA course materials, do not represent income to the Association.

You may not:

• Reproduce, distribute, or modify any training materials without prior written consent.
• Use our materials for commercial purposes without authorization.

9. Payment, Refunds & Cancellations

• All payments for training services are non-refundable unless otherwise stated.
• Cancellation requests must be submitted in writing at least 2 days before the scheduled training.
• No refunds will be issued for failure to attend a scheduled course.
   

10. Privacy & Data Protection

• We collect personal information solely for training registration, certification, and customer service purposes.
• We do not sell, share, or distribute personal information except as required by law.
• By using our Services, you consent to the collection and use of your personal data in accordance with our Privacy Policy.
   

11. Termination of Services

We reserve the right to refuse, suspend, or terminate training services to any participant who:

• Violates these Terms.
• Engages in disruptive, unsafe, or inappropriate behavior during training.
• Provides false information during registration.
   

Termination may result in the revocation of certification without refund.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms shall be resolved through:

1. Negotiation: Parties agree to attempt informal resolution.
2. Mediation: If unresolved, parties may engage in mediation before pursuing legal action.
3. Binding Arbitration or Litigation: Any remaining disputes shall be subject to binding arbitration or litigation in the courts of New York State.
